These Terms and Conditions (“Terms”) govern your access to and use of https://pishondigital.com, including our customer portal, partner portal, and any services described on the site (together, the “Services”), provided by Pishon Digital (“we”, “us”, “our”). By accessing or using the Services, you agree to be bound by these Terms. If you don’t agree, please don’t use the Services.

Our public site is available to anyone. The customer portal, partner portal, and admin areas are restricted to individuals we’ve invited or who have registered as a customer or partner, and are intended for use by businesses and their authorised representatives, not consumers acting in a personal capacity.

If you create an account (customer or partner portal), you’re responsible for keeping your login credentials confidential and for all activity that happens under your account. Tell us immediately if you suspect unauthorised use of your account. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security risk.

Descriptions of our products on this site are for general information and may change as our products evolve. Specific pricing, features, service levels, and availability for a given engagement are set out in the quote, order form, or agreement issued directly to you — not by anything shown on this website, which does not itself constitute a binding offer.

Demo requests, quote requests, and enquiries submitted through this site are not binding commitments by either party until confirmed in writing.

Where you engage us for a paid product or service, payment terms (pricing, billing frequency, and due dates) will be set out in the invoice or agreement we issue to you. Amounts are due as stated on that invoice unless we’ve agreed otherwise in writing. Late payment may result in suspension of the relevant service until the account is settled.

You agree not to:

• Use the Services for any unlawful purpose, or in a way that infringes anyone else's rights
• Attempt to gain unauthorised access to any part of the Services, other accounts, or our systems
• Interfere with or disrupt the integrity or performance of the Services
• Submit false, misleading, or fraudulent information through any form on this site
• Reverse-engineer, decompile, or attempt to extract the source code of our software, except where permitted by law

The Pishon Digital name, logo, website content, and software products are owned by Pishon Digital or our licensors and are protected by applicable intellectual property laws. Using the Services doesn’t give you any ownership of that intellectual property. Any software or content we license to you is governed by the specific licence terms in your agreement with us.

Our site may link to third-party websites or services we don’t control. We’re not responsible for the content, accuracy, or practices of any third-party site, and linking to it doesn’t imply our endorsement.

The Services are provided “as is” and “as available”. While we work to keep the site and portals accurate, secure, and available, we don’t guarantee that they will be uninterrupted, error-free, or free of harmful components. Specific warranties or service-level commitments for a paid product are set out in your agreement with us, not in these Terms.

To the fullest extent permitted by law, Pishon Digital will not be liable for any indirect, incidental, or consequential damages arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the specific product or service giving rise to the claim in the twelve months before the claim arose, unless a different limit is agreed in a signed agreement between us.

You may stop using the Services and close your portal account at any time by contacting us. We may suspend or terminate your access to the Services if you breach these Terms, or where necessary to protect the security or integrity of our systems. Termination of a paid engagement is governed by the terms of your specific agreement with us.

We may update these Terms from time to time. We’ll update the “Last updated” date above when we do. Continuing to use the Services after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of South Africa, and any dispute arising from them will be subject to the jurisdiction of the South African courts, without regard to conflict-of-law principles.
